After the federal government announced that the list of partner countries in the Automatic Exchange of Information (AIA) will be extended by 10 countries, there are also updates on the Spontaneous Exchange of Information (SIA). The Federal Tax Administration has used it for the first time.

What is the Spontaneous Exchange of Information (SIA)?

The spontaneous exchange of information, which takes place between OECD and G-20 countries, is limited exclusively to these countries and is based on reciprocity. The information exchanged includes so-called "Rulings", which are binding advance tax rulings. These are issued in Switzerland by the cantonal tax authorities and forwarded to the Federal Tax Administration, which then transmits the information to its international partner authorities within the framework of administrative assistance proceedings. More detailed information about the SIA can be found in our series of articles.

82 reports to 41 countries

Since January 1, 2017, Switzerland has been receiving information in this way. From January 1, 2018, however, it is also permitted to transmit information itself. The Federal Tax Administration has now made 82 reports, which have been transmitted to 41 countries, including Germany, France, Great Britain, the Netherlands, and Russia. The reports transmitted are tax rulings that were still effective on January 1, 2018, with some rulings being sent to multiple countries.
