As of 09/01/2023, the new Data Protection Act (DSG) and the new Data Protection Ordinance (DSV) will come into effect. This was decided by the Federal Council in the session of August 31, 2022. The legislative changes are intended to both strengthen data protection and simplify its handling.

Data Protection Act (DSG)

The Swiss Data Protection Act has been completely revised. The revision was necessary because both the demands of the population and the technological landscape have changed significantly in recent years. The new DSG is primarily intended to increase the protection of personal data and to be adapted to technological developments. Individuals should have more self-determination about which and how much data they want to disclose about themselves.

Data Protection Ordinance (DSV)

To implement the aforementioned legislative changes, various adjustments to the DSV are necessary. In particular, private individuals will be exempted from certain obligations to provide information when disclosing personal data. Also, the conditions for the right to obtain information have been simplified, and the obligation to document completely removed.

Strength for Switzerland's Economic Location

With the implementation deadline of one year, the Federal Council is accommodating the economy. As of 09/01/2023 the new law is to take effect.

Economically, the revision also helps Switzerland as it ensures compatibility with European law. For Switzerland, clean and simple data transmission with states of the European Union (EU) is very important. Thus, the new DSG strengthens the economic location of Switzerland and hence its competitiveness.
